One of the two surviving roommates in the University of Idaho murder is battling a subpoena requiring him to testify in the defense of murder suspect Brian Coberger.
On Friday, Bethany Funke filed a motion to dismiss the subpoena. Her lawyers argued that her defense’s allegations were unsubstantiated and had no authority to subpoena the 21-year-old woman for a hearing.
“We have no further information or details regarding the content of this testimony, its significance, Mr. Funke’s acquittal information, or why it will be entertained at the preliminary hearing,” the filing said.
Kohberger’s attorneys believe Funke has evidence that could be an important aspect of his defense. They believe the information has the power to clear the client’s name from murder charges.
Bethany Funke has documents regarding the prosecution against Mr. Kohberger. Some of the information Mr. Funke has is innocence to the defendant,” lawyer Richard Bitonti wrote in the affidavit.
“MS. Funke’s information is specific to her experience and not provided by other eyewitnesses.”
The subpoena requires Funke to appear in court in Lata County, Idaho in late June. Kohberger’s hearing is scheduled for his June 26th.th.

Madison Morgen, 21, Cary Gonsalves, 21, Zana Carnold, 20, and Ethan Chapin, 20, were found with fatal stab wounds. had two other roommates. Funk was on his first floor and Dylan Mortensen was on his second floor, where Carnodle and Chapin slept. Two other girls were unharmed.
