Mendoza says he is awaiting forensic analysis of the weapon, projectile, fingerprints and more from the FBI and state forensic doctors before handing over the case to local prosecutors to decide if the criminal charges are appropriate.

“There is a certain degree of negligence: if that reaches the criminal level, it will be determined by the district attorney,” the sheriff told “Good Morning America.”

In a newly released video, a sheriff’s deputy arrives at the set of the movie “Rust” as doctors try to treat Hutchins inside a small wooden church where she was shot during a rehearsal in preparation for filming.

“Halyna, take a deep breath. There you go, good girl,” says one doctor, urging Hutchins to take a breath through an oxygen mask.

Outside, a medical evacuation helicopter lands in the desert. A law enforcement officer watches Baldwin, still dressed in the 19th century, while the actor consumes cigarettes from other members of the film’s cast.


The collection of evidence was made public in response to requests from the media for public records and as an effort for transparency in research. Mendoza, a Democrat, is running for re-election this year, with competitive primaries in June.

Recently released documents show that authorities scraped cell phone bills to search for text messages, pictures and audio files linked to the cast, crew and ammunition vendors for “Rust.” .

Other videos show investigators interrogating Baldwin within hours of the deadly shooting, talking to him inside a compact office and rehearsal clips showing Baldwin disguised as he practices a quick-fire maneuver with a pistol.

A Baldwin lawyer says the newly released files corroborate that Rust’s actor and co-producer were careful with guns on set.

“Sir. Baldwin appreciates this investigation,” attorney Luke Nikas said in a statement. “The information revealed by the authorities shows, once again, that Mr Baldwin acted responsibly.”


In the October 21, 2021 film rehearsal, Baldwin was aiming a gun at Hutchins when he fired, killing Hutchins and wounding Souza.

Under interrogation by two investigators, Baldwin recounts what happened when the gun exploded, unaware initially that Hutchins had died, and was surprised to learn that he was carrying a weapon loaded with live ammunition. Baldwin said the gun should be empty for a no-shoot test.

“I pull out my gun slowly. Turn me around, I’ll drop the gun,” Baldwin said. “Bang, shut up. She (Hutchins) touches the ground.”

Baldwin repeatedly says that there were no previous problems of any kind with firearms on the “Rust” set.

Those statements conflict with the most recent findings from state occupational safety regulators, which last week issued a maximum possible fine of nearly $ 137,000 against film producer “Rust.”

The New Mexico Office of Occupational Safety and Health has presented a scathing narrative of safety failures in violation of industry standard protocols, including evidence that production managers took limited or no action to address two set failures prior to the fatal shooting.


The office also documented the weapons security complaints of crew members that were not addressed and said weapons specialists were not allowed to make decisions about additional security training. Rust Movie Productions has indicated that it will contest the findings and sanction.

Baldwin said in a December interview with ABC News that he was on set pointing the gun at Hutchins according to his instructions when he fired without him pulling the trigger.

At least five lawsuits have been filed for the shooting, including a death warrant for negligence filed by the Hutchins family against Baldwin and the film’s other producers. The lawsuit on behalf of widower Matt Hutchins and his 9-year-old son alleges “insensitive” contempt for security complaints on set.
