Texas calls for halt to investigation of parents of trans teens

AUSTIN, Texas – Texas is appealing a judge’s ruling that prevents the state from investigating the parents of a transgender teenager about the care that confirmed the sex she received.

Republican Attorney General Ken Paxton on Wednesday filed an appeal against the temporary order that paralyzed the Department of Family and Protective Services’ investigation into the parents of the 16-year-old.

Parents demanded the investigation and order from Republican Gov. Greg Abbott last week for officials to investigate reports of treatment as abuse. The lawsuit marked the first report that the parents were investigated following Abbott’s directive and a previous non-binding legal opinion by Paxton that labeled certain gender confirmation treatments as “child abuse.”

The appeal holds a hearing that District Judge Amy Clark Meachum had scheduled for March 11 on whether to issue a broader temporary order blocking compliance with Abbott’s directive.

The lawsuit was filed on behalf of the family by the American Civil Liberties Union and Lambda Legal. The groups also represent a clinical psychologist who said the governor’s board is forcing her to choose between reporting clients to the state or losing her license and other sanctions.

Chase Strangio, deputy director of trans justice for the ACLU LGBTQ and HIV Project, said officials were “doubling their cruelty” with the appeal.

“Our clients and now families across the state are being targeted for the first time by continuing to simply provide the same medically necessary care to their children, as they have done for years,” Strangio said in a statement.

The governor’s directive and Paxton’s opinion go against the country’s largest medical groups, including the American Medical Association, which opposed Republican-backed restrictions on transgender people filed in states across the country.

President Joe Biden on Wednesday night condemned Abbott’s directive and announced measures his administration was taking to protect transgender youth and their families in the state.
