Title 42 lift temporarily shut down as state asks SCOTUS to intervene

McAllen, Texas (border report) — Chief Justice John Roberts ordered to stay on monday Prevents Title 42 from unlocking later this week. The High Court also called on the Biden administration to respond to applications filed by Texas and her 18 other states.

The U.S. Court of Appeals for the District of Columbia on Friday denied the motion to intervene, and the coalition of states now has the district court’s ruling pending before the U.S. Supreme Court, halting the scheduled December 21 termination of Title 42. I am going to petition you.

of 51-page brief filed Monday, State “DHS estimates that daily illegal crossings could more than double to about 7,000 to 15,000/day when Title 42 ends.”

To show the court wants to act quickly, Roberts on Monday called on the Biden administration to respond by 5 p.m. ET on Tuesday.

The state said the Department of Homeland Security is requesting $3.4 billion in emergency funding “to address this crisis.” This further proves that the crisis is massive and will only be exacerbated by the removal of titles, according to the state. 42.

The states participating in the petition are:

  • Missouri
  • Alabama

“Termination of the Title 42 System will do irreparable damage to the state,” the state claims. “[F]Failure to grant a stay here would cause irreparable and extensive damage to the state, especially since it “has owed many of the consequences of illegal immigration.”

A federal judge ordered the termination of Title 42 on Wednesday. This is a public health rule imposed during the Trump administration in March 2020 that allows the automatic deportation of illegal immigrants who enter U.S. borders illegally to help prevent the spread of the coronavirus.

The state claims there has been a “surge of migrants approaching the border in anticipation of the December 21 expiration of their stay.”
