A convicted child killer died in a Florida prison 17 years after kidnapping, raping, and killing an 11-year-old girl. It is also three years after the death penalty was revoked due to a legal loophole.
Joseph Smith, 55, died Monday while waiting for resentment while in custody at the Union Correctional Facility in Raiford, Florida.
The cause of his death is unknown.
Smith, then 39, was convicted in 2006 of the kidnapping, rape, and murder of 11-year-old Curly Brucia.
The Florida Law Firm issued the following statement: “I can’t get Curly back, but I’m grateful that her family, friends, and the entire Sarasota community are finally shut down, and she doesn’t have to endure any further proceedings to bring Smith to trial.
Curly’s father, Joe, told FOX13 “I feel great” when he heard the news that Smith had died. “It’s been late for a long time. The inadequate and corrupt criminal justice system couldn’t achieve it, so the natural order of things finally handled it.
Smith was sentenced to death by lethal injection by a jury vote of 10-2 in March 2006.
However, in 2018, another 2016 Supreme Court ruling that the capital ruling must be unanimous invalidated the ruling.
This happened despite the fact that Smith grabbed Preteen with his arm and was caught by a surveillance camera, dragging her out of Sarasota’s car wash and eventually dying.
Brucia was 11 years old when Smith chased her into an isolated parking lot and kidnapped her.

Preteen was walking home from a friend’s house, past behind Evie’s car wash on 4715 Bee Ridge Road in Sarasota.
She was walking and looking down until Smith approached and grabbed her arm.
The two were seen standing there for a while until Smith took her away on their wrists.
Brucia’s body was found four nights after being raped and killed on the grounds of Christ’s Central Church on 6221 Proctor Road.
Smith was arrested before her body was found and confessed to the crime.
During his trial, Smith was an unemployed auto mechanic, a long-recorded convicted substance abuser, who recently violated probation but was released before the attack on Brucia. It became clear.
Since being placed on death row in March 2006, Smith has repeatedly attempted to appeal.

He was repeatedly denied until the Supreme Court ruled in 2016 in Hurst v Florida that “a unanimous jury recommendation for the death penalty is required before the Trial Court can sentence the death penalty.” ..
This decision was made to retroactively apply to Smith’s proceedings finalized in 2011. This is an order for the jury to impose the death penalty.
According to the Herald Tribune, Brucia’s mother, Susan Scholpen, died at the age of 47. She is said to have lived a troubled life after her daughter’s death and is reported to have died of overdose.
Her death happened about a month after it became clear that Smith might undergo the rehearsal he had long wanted.

Scholpen died of overdose at the age of 47 after struggling to accept the horrific death of his daughter.
At the time of Smith’s first ruling in 2006, Scholpen called Smith an “animal” and expressed how happy she was to be sentenced to death.
“He’s still breathing, but my daughter isn’t … he couldn’t die fast enough for me,” she said.
In July 2018, the lower court first abandoned Smith’s death sentence and ordered another decision to be heard.
Brucia’s father, Joe Brucia, said his family had been deprived of justice at the time.

“Obviously, that’s a very bad decision. He committed a crime, a horrific crime, and Florida convicted him and sentenced him to death,” he told Herald-Tribune.
“I wasn’t surprised, I was just disappointed. I don’t think it’s a system of pursuing justice. It’s a system created for lawyers.”
“It’s anger. It doesn’t benefit anyone but a lawyer,” Brucia added. “They will probably spend millions of dollars on this case so far … what he needs is to be executed.”
In July, Smith asked Judge Charles Roberts of the 12th Circuit to immediately substitute life imprisonment, but the request was dismissed and his revocation was appealed to the Florida Supreme Court.
In Smith’s decision, only 10 of the 12 juries voted for the death penalty instead of life imprisonment, so the Supreme Court upheld the circuit court’s order and his death sentence was formally invalidated.
A new jury was set to rule Smith, but the date he died was not set.
