Texas Governor Greg Abbott said he hopes a pardon will be granted to Army Sergeant Daniel Perry. This came a day after Perry was found guilty of murder for shooting Garrett Foster during a Black Lives Matter demonstration in 2020.

According to Board spokesperson Rachel Alderete, “the Board will begin its investigation immediately,” and will report back to the governor when the investigation is complete. The board did not immediately disclose how long the investigation would take or whether an appeals process would be required before making a recommendation.

Garrett Foster was shot dead by White Army Sergeant and rideshare driver Daniel Perry during a Black Lives Matter protest in Austin, Texas in 2021. Foster was also white. Perry was charged with dangerous conduct and aggravated assault with a deadly weapon for his actions during the protest.

According to Perry’s claims, Foster approached Perry’s automobile with an assault rifle, and Perry opened fire in self-defense. Perry dropped a client off near the protest because his black parent, George Floyd, had died in custody the day before, claiming he was unaware it was happening. On Friday, a Travis County jury found Perry, 35, guilty of murder. The county prosecutor’s office is still investigating the manslaughter charge, even though a jury found him not guilty of aggravated assault with a dangerous weapon.
